General conditions of sale A.absolutely
Preamble
These general terms and conditions of sale (GTC) are applicable to direct sales made by the company A.bsolument, located at 65 boulevard Côte Blatin, 63000 Clermont-Ferrand, France, registered under SIRET number 80979990100040, with a share capital of €1,204.90, to private and professional customers.
Acceptance of Terms
Any order for products from A.bsolument implies the unconditional acceptance by the buyer, whether individual or professional, of these general terms and conditions of sale. These T&Cs are written in French and are subject to French law. In the event of a dispute, only the French text is authentic.
- General provisions
These T&Cs exclusively govern the relationship between the company A.bsolument and its customers, whether individuals or professionals. They prevail over any other contradictory document, unless specifically agreed in writing between the parties.
- Products and compliance
The products sold by A.bsolument are described as accurately as possible. However, in the event of discrepancies or errors in this description, A.bsolument cannot be held liable. The products are offered within the limits of available stocks. In the event of non-conformity, the return and refund conditions apply (see article 7).
- Price
Prices are indicated in euros and include the applicable VAT for private customers. For professional customers, prices are displayed excluding taxes, the applicable VAT being added at the time of invoicing. Prices may be modified at any time, but products are invoiced on the basis of the rates in effect at the time of the order or signing of the quote. Discounts or special conditions may be negotiated for professionals depending on the volume or recurrence of orders.
- Order
For offline sales, an order is validated after the customer signs the order form or quote and, if applicable, pays an agreed deposit. An order confirmation will be sent by email or post to the customer, whether individual or professional.
- Payment
Payment is due in full upon delivery, unless otherwise specified when ordering. Accepted payment methods include credit card, bank transfer, check or PayPal. For business customers, specific payment terms may be set up (e.g. 30-day payment), subject to prior agreement. In the event of late payment, penalties may be applied, calculated on the basis of the legal interest rate in force.
- Delivery
The delivery of the products is made to the address indicated by the customer when ordering. Delivery times are given for information purposes only. If the times exceed thirty days, the private customer can cancel the order and obtain a refund. For professional customers, specific delivery conditions may be agreed as part of the contract.
- Right of withdrawal and return of products
- Private customers : In accordance with the Consumer Code, the private customer has a right of withdrawal of 14 days from receipt of the products. The products must be returned in their original condition and complete. The return costs are the responsibility of the customer.
- Professional customers : The right of withdrawal does not apply to professionals, unless specifically agreed in advance. In the event of non-conformity of the products, the conditions of return and reimbursement are negotiated on a case-by-case basis.
- Guarantees
The products benefit from the legal guarantee of conformity for individuals and the guarantee of hidden defects for professionals and individuals. In the event of non-conformity or hidden defect, the products can be returned, exchanged or refunded according to the terms of the sales contract. The duration of the legal guarantee of conformity is 5 years from delivery for individuals.
- Protection of personal data
Personal information collected during direct sales is used only for order management purposes and may be shared with A.bsolument partners involved in the execution of the sale. In accordance with the GDPR, customers have the right to access, modify, and delete data concerning them.
- Force majeure
A.bsolument shall not be liable for any failure to perform or delay in performing any of its obligations due to force majeure. Force majeure events include, but are not limited to, natural disasters, strikes, epidemics, transport blockages, or any other circumstances beyond the control of the company.
When receiving your package, it is imperative to systematically issue a reservation in the event of apparent damage. If breakage is noted upon delivery and no reservation has been made at the time of receipt, we will not be able to initiate litigation proceedings with our carrier. The absence of reservations will render any subsequent claim inadmissible.
We decline all responsibility for breakages occurring during delivery if no reservation has been made. It is your responsibility to check the condition of the package upon delivery and to indicate any anomalies. For more details on delivery conditions and complaints, please refer to article 10 of our General Terms and Conditions of Sale (GTC).

- Competent jurisdiction
In the event of a dispute, and in the absence of an amicable agreement, any disagreement relating to the interpretation or execution of these General Terms and Conditions will be subject to the exclusive jurisdiction of the French courts. For professionals, this jurisdiction may be that of the commercial court of the registered office of A.bsolument.
